1. Service Description

YourAI is a service provided by BlastChamber LLC ("we", "us", "our") that builds, deploys, and maintains AI companion systems for individuals and businesses. We offer two service paths: local hardware stations deployed on-premises, and cloud-hosted AI companions accessible via web browser.

2. Acceptance of Terms

By purchasing or using our services, you ("customer", "you") agree to these Terms of Service. If you do not agree, do not purchase or use our services.

3. Local Hardware Stations

For local hardware purchases:

The hardware becomes your property upon delivery and full payment
The Hermes Agent software is open-source and licensed under its respective license
Monthly maintenance fees cover software updates, personality tuning, and remote support
You are responsible for physical security of the hardware
We retain the right to access via Tailscale VPN only for scheduled maintenance or support requests
You may revoke remote access at any time, but this may limit our ability to provide support

4. Cloud-Hosted Service

For cloud-hosted subscriptions:

Your subscription grants access to a dedicated cloud AI companion instance
Cloud instances are isolated per customer — no shared data between accounts
You may cancel at any time; service continues until the end of the current billing period
Cancelled accounts will have data retained for 30 days, then permanently deleted
We reserve the right to suspend service for abuse, illegal activity, or Terms violations

5. Fees and Billing

Setup fees are one-time charges due before deployment
Monthly maintenance/subscription fees are billed in advance via Stripe
Fees are non-refundable except where required by law
We may change pricing with 30 days' notice to active customers
Late payments on local maintenance contracts may result in suspended remote support

6. AI Model APIs

Your AI companion connects to third-party AI model APIs. You are responsible for:

Providing your own API keys where required (Professional and Enterprise tiers)
Reviewing and accepting the terms of service of any AI model provider used
Any costs incurred directly from AI model providers
Ensuring your use of AI services complies with applicable laws and provider terms

For Essential and Starter tiers, API costs are included in your monthly fee. For higher tiers, we will discuss API arrangement options during consultation.

7. Acceptable Use

You agree not to use your AI companion to:

Generate illegal, harmful, or abusive content
Harass, defame, or threaten any person
Infringe on intellectual property rights
Attempt to access, disrupt, or compromise our infrastructure or other customers' systems
Resell or redistribute our service without authorization

8. Warranty and Disclaimers

Services are provided "as is" without warranty of any kind. We do not guarantee that AI outputs are accurate, reliable, or fit for any particular purpose. AI models may produce incorrect or unexpected results. You are responsible for verifying any important information provided by your AI companion.

For local hardware, the hardware manufacturer's warranty applies. We provide a 30-day setup warranty covering configuration and deployment issues.

9. Limitation of Liability

BlastChamber LLC's total liability for any claim arising from these services shall not exceed the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including loss of data, business interruption, or AI-generated content.

10. Data Ownership

You own all data generated through your AI companion — conversations, personality profiles, and configurations. For local stations, all data resides on your hardware. For cloud instances, we act as a data processor on your behalf and will export or delete your data upon request.

11. Cancellation and Termination

You may cancel your subscription at any time by emailing [email protected]. Setup fees are non-refundable. Monthly fees are non-refundable for the current billing period but will not be charged for subsequent periods.

We may terminate services for Terms violations with 7 days' written notice, except in cases of illegal activity (immediate termination).

12. Governing Law

These terms are governed by the laws of the State of Illinois, United States. Any disputes shall be resolved in the courts of Winnebago County, Illinois.

13. Changes to Terms

We may update these Terms as our service evolves. Active customers will be notified via email of any material changes. Continued use after changes constitutes acceptance.
